Open Recommendations

Rec. 1.a.1: The DoD OIG recommended that the Under Secretary of Defense for Acquisition and Sustainment, in coordination with the Program Executive Officer for the F'35 Joint Program Office modify the F'35 air vehicle sustainment contract to include incentive metrics and associated remedies that closely align with or support the performance requirements outlined in the bilateral Performance'Based Arrangement or obtain a waiver for not including the performance requirements from each Military Service.

Rec. 1.a.2: The DoD OIG recommended that the Under Secretary of Defense for Acquisition and Sustainment, in coordination with the Program Executive Officer for the F'35 Joint Program Office modify the F'35 air vehicle sustainment contract to include contract requirements that contain specific metrics and associated remedies, including the development of metrics for action requests, property transfer responses, and resolution timelines.

Rec. 1.a.3: The DoD OIG recommended that the Under Secretary of Defense for Acquisition and Sustainment, in coordination with the Program Executive Officer for the F'35 Joint Program Office modify the F'35 air vehicle sustainment contract to include property clauses the Defense Contract Management Agency considers necessary in future option years.

Rec. 1.b: The DoD OIG recommended that the Under Secretary of Defense for Acquisition and Sustainment, in coordination with the Program Executive Officer for the F'35 Joint Program Office enforce the requirement for Lockheed Martin to provide a completed DD Form 250, Material Inspection and Receiving Report, or its electronic equivalent.

Rec. 2.a: The DoD OIG recommended that the Program Executive Officer for the F'35 Joint Program Office align the contracting officers representative responsibilities to monitor and report impactful evaluation data on Lockheed Martins performance, including the impact of cannibalization of spare parts on aircraft readiness, and update these responsibilities in the Quality Assurance Surveillance Plan.

Rec. 2.b: The DoD OIG recommended that the Program Executive Officer for the F'35 Joint Program Office provide all contracting officers representatives a detailed Performance Work Statement and appropriate access to databases and information required to accomplish effective oversight.

Rec. 2.c: The DoD OIG recommended that the Program Executive Officer for the F'35 Joint Program Office coordinate with the Military Services to complete a workforce study to determine appropriate contracting officers representative requirements and staffing levels for the F'35 air vehicle sustainment contract.

1a. Amend the company’s infrastructure asset management strategy to
include specific objectives and performance metrics for bringing its assets
into a state of good repair.

1b. Develop and implement an approach to communicate the company’s
infrastructure asset management policy companywide.

1c. Amend the company’s infrastructure asset management plan to include
activities and resources needed to meet its objectives, and develop and
implement an approach to communicate roles and responsibilities to
internal stakeholders.

2a. Complete ongoing efforts to align the company’s infrastructure asset data
between Maximo and GIS. This should include re-establishing a feature to
automatically update these data.

2b. Establish a process to regularly validate that the company’s infrastructure
data are complete, accurate, and aligned between systems, as appropriate.
As part of this process, regularly monitor the effectiveness of the
company’s practice to add and remove infrastructure assets in Maximo
and GIS.

2c. Complete ongoing infrastructure condition assessments and establish a
process to ensure that the company uses these assessments to inform
SOGR activities.

We recommend that the Assistant Secretary of Commerce for Communications and Information Administrator, in coordination with the Department’s Senior Procurement Executive and Director of Acquisition Management, direct FirstNet Authority’s Chief Executive Officer and Chief Procurement Officer to: Ensure that future NPSBN contracts and task orders sufficiently define performance standards and measurements of success for achieving requirements prior to their award to protect the government’s interest in accordance with the FAR.

We recommend that the Assistant Secretary of Commerce for Communications and Information Administrator, in coordination with the Department’s Senior Procurement Executive and Director of Acquisition Management, direct FirstNet Authority’s Chief Executive Officer and Chief Procurement Officer to: Ensure service availability requirements for the 5G network and Pacific territories are clearly defined within the contract.

We recommend that the Assistant Secretary of Commerce for Communications and Information Administrator, in coordination with the Department’s Senior Procurement Executive and Director of Acquisition Management, direct FirstNet Authority’s Chief Executive Officer and Chief Procurement Officer to: Modify the current NPSBN QASP to ensure that:

(a) The method for measuring service availability is designed to protect the government’s interest and ensure that services rendered by AT&T meet contract requirements and that the measurement provides a complete and accurate assessment of service availability.
(b) Surveillance methods are sufficiently defined and detailed to verify that AT&T’s performance meets service availability contract requirements…

We recommend that the Assistant Secretary of Commerce for Communications and Information Administrator direct FirstNet Authority’s Chief Executive Officer and Chief Procurement Officer to: Conduct sufficient surveillance of service availability prior to acceptance of contract deliverables, including obtaining appropriate data required for oversight, performing random audits, reviewing AT&T’s QCP results, and applying timely remediation procedures in instances of noncompliance, as directed in the QASP and the FAR.

We recommend the Vice President, Nuclear Engineering, evaluate probability of occurrence and financial impact to verify they are accurately reported.

We recommend the Vice President, Nuclear Engineering, take steps to ensure that risk information in the Enterprise Risk Management system of record is accurate.

The Commissioner, LB&I Division, should assess the compliance risk of **********2**********, and the viability of using Form 1099 data to identify Form 8938 nonfilers to improve the compliance efforts of Campaign 896.

We recommend the Vice President, Power Supply and Fuels explore options to amend the 2024 compliance report to reflect the accurate number of RECs to be carried forward.

We recommend the Vice President, Power Supply and Fuels take steps to ensure the accuracy of information provided in compliance reports.

We recommend that the NOAA Deputy Under Secretary for Operations ensure that OMAO establishes standard operating procedures to support the QAP for ship construction for the Class B program.

We recommend that the NOAA Deputy Under Secretary for Operations ensure that OMAO establishes a ship-specific surveillance plan in accordance with the QAP.

We recommend that the NOAA Deputy Under Secretary for Operations ensure that OMAO establishes an enterprise-wide acquisition knowledge management system to record and track programmatic, contracting, and technical lessons learned for the Class B program that can be implemented for subsequent classes of new ships or other major acquisitions.
