We recommend that the New York State Department of Health (the State Agency) refund $1,943,190 to the Federal Government.

We recommend that the New Mexico Human Services Department refund $12,422,181 to the Federal Government.

We recommend that the New Mexico Human Services Department work with CMS to determine the appropriate amount of the additional $750,811 that it should have claimed and refund the Federal share difference.

We recommend that the New Mexico Human Services Department establish policies and procedures to account for adjustments MCOs make to IHS encounter data after reconciliations are completed.

Rec. 3.a.3: The DoD OIG recommended that the Defense Media Activity Director for Acquisition and Procurement provide training for the contracting workforce emphasizing compliance with Federal Acquisition Regulation Subpart 46.4, "Government Contract Quality Assurance," Subpart 46.103, "Contracting Office Responsibilities," and Defense Federal Acquisition Regulation Supplement 246.102, "Policy."

Rec. 4.d: The DoD OIG recommended that the Director of Defense Media Activity develop and implement agencywide quality controls to ensure that newly issued internal policy and guidance had corrected deficiencies in contract award and administration.

Ensure that Red Wind enhances its accounting system and the accounting policies and procedures to ensure that it maintains complete and accurate accounting records for the awards.

Ensure Red Wind updates and enforces the BOD Bylaws.

Remedy the $229,845 of unsupported costs for excess funds drawn down through March 20, 2021.

Rec. B.1.c: The DoD OIG recommended that the Defense Health Agency Director, in coordination with the Military Services, should review the civilian hiring and retention practices for substance abuse personnel and make applicable improvements to minimize vacant positions.

Conduct a review of MFP policies and guidance to identify controls over producer self-certifications that could be strengthened and used in future programs to improve payment accuracy.

Conduct a review to evaluate the effects of using regularly captured data and automated processes on program vulnerabilities, and document the results for use in designing future programs.

Propose a plan with reasonable timeframes to periodically monitor whether any new or temporary FSA programs reliant on production evidence use or depart from using 1-NAP production evidence standards. The plan should ensure that departures from 1-NAP are documented and changes in policy are adequately communicated.

To ensure that the State agency complies with Federal requirements and does not claim unallowable costs, we recommend that the Centers for Medicare & Medicaid Services direct the State agency to revise the Process Guide to include days worked during September in RMTSs.
