Open Recommendations

We recommend that the State agency bill for and collect from manufacturers rebates for single-source and top-20 multiple-source physician-administered drugs and refund to the Federal Government the estimated $18,326,775 (Federal share).

We recommend that the State agency strengthen the NDC edit (implemented on October 1, 2012) to ensure that NDCs are captured and valid for all drug utilization data.

We recommend that the State agency ensure that all physician-administered drugs eligible for rebates are processed for rebates.

We recommend that the State agency work with CMS to determine whether the other physician-administered drugs were eligible for rebates and, if so, upon receipt of the rebates, refund up to an estimated $7,307,853 (Federal share) of rebates collected.

In coordination with the Office of Enforcement and Compliance Assurance, develop and implement a methodology to evaluate the impact of the revised Agricultural Worker Protection Standard on pesticide exposure incidents among target populations.

We recommend that WPS notify the 208 providers responsible for the remaining 44,820 nonsampled claims, with potential overpayments estimated at $42.3 million, so that those providers can investigate and return any identified overpayments in accordance with the 60-day rule and track any returned overpayments.

Evaluate the results for the 41 beneficiaries in our sample and determine whether it should review the remaining population of 13,514 beneficiaries.

Determine whether it should develop additional controls to ensure it informs widow(er) beneficiaries of their option to delay their application for retirement benefits.

Coordinate with the Army Corps of engineers to enhance existing procedures and related controls to ensure all material procurement of goods and services received prior to period-end are timely and accurately accrued.

We recommend that the Director of HUD's Newark Office of Public Housing require the Authority to provide documentation to show that the $1,294,062 paid to the Long Branch Housing Authority was for eligible, reasonable, necessary, and allocable costs or reimburse its Operating and Capital Fund programs from non-Federal funds for any amount that it cannot support or that is not considered reasonable.

The Commissioner, Wage and Investment Division, should correct programming to reject EIN applications when an EIN has previously been assigned to the same sole proprietor and to reject applications when IRS data indicate that the sole proprietor is deceased.

The Commissioner, Wage and Investment Division, should develop programming to reject estate applications if the decedent TIN is not that of a deceased individual.

Periodically track the use and effectiveness of ongoing initiatives and tools used to monitor and reduce visitor wait times, where possible.

The OIG recommends that OPM cease implementing the Retirement Insurance Letter (RIL) 2016-12 and OS Clearinghouse 359 memorandum to apply the state court-ordered marital share to Annuity Supplements unless those court orders expressly and unequivocally identify the Annuity Supplement to be apportioned.

The OIG recommends that OPM take all appropriate steps to make whole those retired law enforcement officers (LEOs) and any other annuitants affected by this re-interpretation. This would include reversing any annuities that were decreased either prospectively or retroactively that involved a state court order that did not expressly address the Annuity Supplement.

The OIG recommends that OPM determine whether it has a legal requirement to make its updated guidance, including Retirement Insurance Letters, publicly available.

We recommend that the Southwest Region Director of Multifamily Housing require Villa Main Apartments owner to repay HUD $534,741 for 39 subsidized units with ineligible "ghost" tenants.

We recommend that the Southwest Region Director of Multifamily Housing require Villa Main Apartments owner to provide support that the subsidized 43 units without annual physical inspections, without required EIV reports, or with missing files were eligible or repay HUD $1,095,364 for those subsidies.

We recommend that the Southwest Region Director of Multifamily Housing require Villa Main Apartments owner to implement appropriate controls to ensure tenants are eligible, housing assistance subsidies are accurate, and that units are inspected as required.

We further recommend that the Southwest Region Director of Multifamily Housing verify that the owner is providing oversight to its onsite staff and its recently implemented quality control program is working as designed and in accordance with HUD requirements.

We further recommend that the Southwest Region Director of Multifamily Housing ensure that the project-based contract administrator's review process includes steps to obtain reasonable assurance that tenants being reported as subsidized at Villa Main qualify for the program and live in the subsidized units.

Resolve the electrical configuration issue of the STARS rack assemblies at each of the 11 TRACONs by either: (a) obtaining approval for the configuration from a nationally recognized testing laboratory or (b) assessing and documenting risks posed by the STARS rack assemblies installed at each of the 11 facilities and FAA's acceptance of that risk on air traffic operations.

Collaborate with industry stakeholders to develop and implement a plan to collect and analyze reliable, accurate, and representative data on the frequency and severity of driver detention times.

Rec. A.3.a: The DoD OIG recommended that the Commander of Navy Installations Command issue guidance to emphasize that tenant organization personnel on Navy installations should coordinate the acquisition of relocatable buildings with the installation's Department of Public Works personnel.

Rec. A.4.a: The DoD OIG recommended that the Directorate of Public Works Chief, Marine Corps Base Camp Pendleton, apply for approval of relocatable buildings that initially were never submitted for approval.

Rec. A.4.b: The DoD OIG recommended that the Directorate of Public Works Chief, Marine Corps Base Camp Pendleton, establish exit strategies for relocatable buildings that do not have one.

Rec. A.4.c: The DoD OIG recommended that the Directorate of Public Works Chief, Marine Corps Base Camp Pendleton, request extensions for relocatable buildings that are past the established expiration date and still needed or terminate the use of the relocatable buildings that are no longer needed.

Rec. A.5.a: The DoD OIG recommended that the Directorate of Public Works Chief, Marine Corps Base Camp Lejeune, apply for approval of relocatable buildings that initially were never submitted for approval.

Rec. A.5.b: The DoD OIG recommended that the Directorate of Public Works Chief, Marine Corps Base Camp Lejeune, develop procedures to ensure that personnel are performing the required lease-versus-buy analysis before extending existing leases or obtaining additional relocatable buildings.

Rec. B.3.a: The DoD OIG recommended that the Commandant of the Marine Corps revise Marine Corps Order 11000.12, Appendix G, and the Marine Corps Headquarters GF-6 Real Estate and Real Property Accountability Handbook to reflect updates made to Department of Defense Instruction 4165.56 and train Department of Public Works personnel on the proper classification of relocatable buildings.

Rec. B.3.b: The DoD OIG recommended that the Commandant of the Marine Corps develop procedures to ensure that Department of Public Works personnel properly apply the interim facility requirement when classifying relocatable buildings as required by Department of Defense Instruction 4165.56.

Rec. B.3.c: The DoD OIG recommended that the Commandant of the Marine Corps revise guidance to separate non-relocatable buildings from properly classified relocatable buildings within the Internet Navy Facility Assets Data Store system for tracking all facilities if fire and emergency services are needed.

Rec. B.4: The DoD OIG recommended that the Chief of Naval Operations revise the Office of the Chief of Naval Operations Instruction 11010.33C to reflect updates made to Department of Defense Instruction 4165.56 and train Department of Public Works personnel on the proper classification of relocatable buildings.

Implement controls to continuously monitor and work with components to ensure network administrators are informed and action is taken to disable system accounts when users no longer require access or have been inactive beyond established thresholds.

Revise the Emergency Relief Manual to include a definition of resilience improvement and identify procedures States should use to incorporate resilience into ERP-funded projects.

Track and ensure that Volunteers returns to the Treasury any funds recovered through the ongoing litigation pertaining to the Yabucoa housing project.

Return to the Puerto Rico Department of Housing $1,057,467, plus any interest earned, for the duplicate special escrow fund payments it received.

Risk Management

FDA should develop a policy for defining and a procedure for identifying retrospectively the date that FDA learns of a potentially hazardous product and consider adding a field for the date to the RES or another FDA system so that FDA staff involved in managing a recall have access to this information
