| Text of Recommendation | We recommend that the Director of the Census Bureau obtain an opinion from the Department of Commerce Office of General Counsel to determine whether funds from the IOE program, carried over in FY 2010 and FY 2011, are considered earned revenue and were carried over in compliance with appropriations law (and, in addition, notify the Department’s Chief Financial Officer and Assistant Secretary for Administration of the results—and, if noncompliance is noted, develop controls to track the original period of availability of IOE program funds).
